Products:
Whilst we endeavour to ensure that the colour and description of all items shown on this site are as accurate as possible items may differ slightly due to the photographic procedure and transferring of images to the website. Most of our photos are taken indoors with flash. Where sizes are given these are approximate. If you have purchased an item that you feel has been misleading on the website please contact us as soon as possible after purchase. Due to Supplier and Manufacturer changes we reserve the right to alter, increase price, remove or amend any product on our website without prior notice. All items shown on the website should be in stock as this is updated daily, however during busy periods we cannot guarantee stock availability. We change and update our stock based on a seasonal basis and customer demand and therefore any item may be removed from the website permanently without notice. Where products are listed as made of a certain material or being vegan friendly etc we are basing this on the information given to us by our Suppliers and will not be responsible should this prove to be inaccurate.

Out Of Stock Items:
We update the website daily and any items out of stock are removed. In busier periods there may be a slight delay in removing out of stock items from the main website but generally if an item is shown on the website then it is in stock. If you have ordered an out of stock item we may a)refund you in full for this, b)place the item on back-order for you or c)send an alternative item of the same of greater value. Refunds will generally be made by the same method as we received payment, Back-Orders will be sent when items are received back into stock and for the agreed price with no additional cost for delivery, Alternative Items would be of a similar style but may be slightly different cosmetically or of a different colour - we would always try to contact the customer beforehand where possible to confirm if they would prefer refund, back-order or alternative item but in order to meet delivery deadlines e.g. for Next Day Delivery this may not always be possible.

Lost Orders:
Due to Royal Mail Guidelines we cannot issue a refund or replacement for any lost order until you have completed a Lost Order Form confirming non-delivery. You must return this form to FunkyEars within 10 days or Royal Mail will deny the claim which in turn means we cannot reimburse you for any loss. This procedure may delay your refund/replacement being arranged. If you prefer you can place a new order for the items to be re-sent straight away and we will refund the original payment upon confirmation from Royal Mail they have received and accepted your P91 Form (updated 29th January 2007 / based on Royal Mail Guidelines). Please note Royal Mail may take upto 30 days to decide whether to approve or reject your claim and we may wait on their response before sending a replacement or refund. If we decide to send a replacement before the claim is approved by Royal Mail we reserve the right to Invoice you in full for these products should Royal Mail dispute or reject the claim. Please note that we prefer not to leave parcels in bins, under benches, behind car etc as these parcels will not be covered against loss/theft - should you wish a parcel left in an un-secure area on your property please bear in mind that you will not be refunded if the order is stolen/undelivered unless Royal Mail agree to fully refund us - this can take upto 30 days for a decision and we will not send a refund or replacement order until we have confirmation of Royal Mail's acceptance of the claim. Should a Recorded Delivery or Next Day Delivery not be received by the customer but we have signature confirmation then it will be the customers responsibility to dispute this with Royal Mail although we will assist and supply any additional information we can. Royal Mail may NOT refund us if they have a signature for these types of delivery and it down to the customer to prove to Royal Mail the signature is not theirs (or of someone they know signing on their behalf). Any delivery delay due to postal strikes or other industrial action will not be eligible for a postage refund - this also applies to Guaranteed and Next Day Deliveries although the customer may be able to claim direct from Royal Mail depending on the circumstances.


Prices:
All prices shown on FunkyEars are in Pound Sterling (GB Pound / £) and include VAT. EU Members with a valid VAT Number may contact us prior to placing an order to have their items reduced to zero VAT (excl UK). All VAT numbers will be checked for authenticity and refunds cannot be given afterwards should a VAT number be provided at a later date. VAT is not payable on non UK and EU orders. VAT is based on delivery country.

Age Limits:
FunkyEars will not sell to anyone under the age of 14. For some of our items you may have to be over 18 or have a parent or guardians permission before purchasing. FunkyEars will not be held responsible for any minor purchasing via this website and reserve the right to refuse any order or refund any item we deem unsuitable for the purchaser when under 18 years of age. By purchasing from this website you are confirming you are at least 14 years of age and have the relevant permission to use these products.

Safety:
Any Guides, Information, Descriptions, Reviews, Hints or Tips on this website may have been submitted by customers and site visitors and we therefore cannot guarantee the accuracy of these items. We cannot be held responsible for any injury, accident, or death resulting in the misuse of any products on this website - the purchaser takes full responsibility in law. .Allergic reactions can occur at any time, even with products previously used and we strongly recommend you always do a sensitivity test before using any item purchased from this site. Should you have a problem with a product purchased from FunkyEars please stop using the product immediately and contact us with details - in some cases we may require the item(s) back for testing.

Competitions / Promotions / Special Offers:
We reserve the right to close or remove any special offers, promotions and / or competitions on our website at any time without prior notice. Any winners of competitions will be decided by FunkyEars Staff unless another method of choosing winner has been stated in that competitions terms and conditions. Special Offers and Promotions are only valid whilst advertised on our site under our Sale or Special Offers Section and we take no responsibility for any vouchers, promotional codes un-used after that specific promotion has closed. With Buy One Get One Free (BOGOF) promotion free items may be any colour or a different style from the item purchased, unfortunately we are unable to guarantee specific colours/items with these promotions. If you are returning an order any free or promotional items included with the original purchase must be returned also.

Customer Information:
Customers are solely responsible for ensuring the details they have provided are accurate and up-to-date. Should a payment be returned due to an invalid card or account being used we will Invoice the customer for a full refund of any charges we incur. If a customer supplies an old, incorrect or incomplete address we will not be held responsible should their order not be received - we would refund / send replacement only when/if the original is returned to us by Royal Mail and this would be less any postage, packaging or payment charges we have incurred. To avoid any problems please ensure all contact information is kept up-to-date and check this each time you order.
